The petitioner was appointed on provisional basis in the cadre of West Bengal Medical Education Service on October 27, 2014 as an RMO cum Clinical Tutor in the discipline of Pathology. She is presently an Assistant Professor, Pathology at IPGME&R, SSKM Hospital, Kolkata. She had thereafter participated in the recruitment process for the post of Associate Professor of Pathology of the Dr. B.C. Roy Multi Speciality Medical Research Centre (IIT, Kharagpur). 3. The petitioner has been selected and has applied for a no objection/technical resignation from her post at IPGME&R, SSKM Hospital, Kolkata. The last date for joining at Dr. B.C. Roy Multi Speciality Medical Research Centre (IIT, Kharagpur) is 2 November 16, 2026. In view thereof, the petitioner’s application which is nothing more than a technical resignation has to be read in the light of the Rule 33(2) of the West Bengal Services (Death-cum- Retirement) Rules, 1971. 4. The concerned authority is directed to take a decision on this issue by September 30, 2026, and communicate the resultant order to the petitioner by October 5, 2026. 5. With the afore-stated direction, the writ petition is disposed of. 6. There will be no order as to costs. 7.
