Kausik (Rejected) CRM (A) 2967 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Galsi Police Station Case No. 170 of 2026 dated March 04, 2026 under Sectioins 126(2)/117(2)/118(2)/109(1)/74/351(2)/3(5) of the BNS, 2023. And In the matter of : Hriday Ghosh @ Shrikanta Ghosh & Ors. ……Petitioners. Mr. Swapnil Mukherjee Mr. Soumyadeep Das ……for the Petitioners. Mr. Pradip Kumar Singh Mr. U. Garodia ….for the State. Learned advocate appearing for the petitioners submits that petitioners are innocent. Injured suffered road traffic incident. Pursuant to which the information was lodged at the police station. Consequent to which petitioners have been implicated. It has also been submitted that another accused namely, Babu Ghosh has been granted anticipatory bail by a co-ordinate Bench in CRM (A) 2529 of 2026. As such, petitioners be granted the same privilege of anticipatory bail. 2 Learned advocate for the State produces the case diary, draws the attention of the Court to the statement of the injured and the injury report. I have taken into account the injuries and is of the opinion that so far as the other accused whose anticipatory bail was granted, the same is because he is a student of engineering college. So far as the present petitioners are concerned, there are accusations of physical assault. The same is supported by the injured statement. I find that the injured had to be administered number of stitches. As such having regard to the gravity of the offence, I am not inclined to grant the privilege of anticipatory bail to the present petitioner. Accordingly, prayer for anticipatory bail of the petitioners namely, (1) Hriday Ghosh @ Shrikanta Ghosh, (2) Riju Ghosh, (3) Sanjib Ghosh is dismissed. Accordingly, CRM (A) 2967 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
