This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer:
“…to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents not releasing the amount of Rs.8,79,911/- vide M Book No. 8978/A, even after finalizing the bills, payable to the petitioner in relation to the works i.e., Construction of Community hall in ST Colony of Chowduwada K.Kotapadu Mandal, Anakapalli District PR4860- 9229, vide Agreement No. /2023-24/Dt.23.11.2023 of the Executive Engineer PRI Anakapalli under GGMP Grant is questioned, as the same is illegal, arbitrary and consequently direct the respondents to pay for payment of amount of Rs.8,79,911/- vide M Book No. 8978/A to the petitioner in respect of execution of above-mentioned work forthwith and to pass…”

Case of the petitioner company, in brief, is that pursuant to the administrative sanction accorded by 3rd respondent vide proceedings in Rc.No.30/2022/CPO/Dy.S.O.(Plg.II)/Dt:22.08.2023 for execution of work, namely, ‘Construction of Community hall in ST Colony of Chowduwada, K.Kotapadu Mandal, Anakapalli District’ under GGMP Grant, 4th respondent issued the Technical sanction proceedings and entered into an agreement with the petitioner for execution of the said work. The petitioner completed the execution of work and submitted a bill for an amount of Rs.8,79,911/-. Thereafter, the respondent Nos.4 and 5 issued the statement of work done by

the petitioner in accordance with the terms of the agreement. However, the respondents have failed to release the said amount till date. Aggrieved thereby, the present Writ Petition has been filed seeking a direction to the respondents to release an amount of Rs.8,79,911/- as per M-Book to the petitioner herein along with interest. 3. Heard. Perused the record. 4. Learned Assistant Government Pleader for Panchayat Raj & Rural Development, on written instructions, submits that the petitioner executed the work, which was estimated at Rs.10.50 lakhs, and that the value of the work executed was assessed at Rs.10,36,114/- (including GST & SC).
She further submits that the balance amount payable to the petitioner is Rs.9,32,209/-, however, the petitioner restricted its claim in the present Writ Petition to Rs.8,79,911/-. It is further submitted that as and when the funds are released from Government, the respondents will arrange payment to the petitioner. She, therefore, seeks three months’ time to make payment of the said amount. The written instructions are placed on record. 5. Having regard to the fact that there is no dispute with regard to the work executed by the petitioner and in view of the submissions made by the learned Assistant Government Pleader for Panchayat Raj & Rural Development, the respondent authorities are directed to pay the admitted amount of Rs.8,79,911/- (Rupees Eight Lakhs Seventy-Nine Thousand Nine Hundred

and Eleven only) to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
