Learned advocate for the petitioners submits that the petitioners have been falsely implicated in connection with the instant case as they came to visit the house of an acquaintance. The petitioners claim parity of one Konika Roy who has been granted bail. Learned advocate for the State opposes the prayer for bail and submits that the seizure in this case is 25 kg 542 gm of ganja which are above the commercial quantity and one of the accused persons from whose house the recovery has been made is still absconding. However, so far as the issue relating to parity is concerned, the same has different perspective and there cannot be an uniformity amongst the two accused persons.
2 The factual circumstances of the accused may differ on their participatory role in the crime. Having considered that the quantum of recovery in the present case is above 25 kg, I am of the opinion that the rigors of section 37 of the NDPS Act are attracted. Having considered the same, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (NDPS) 1925 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
