10.09.2026 Serial no. 40 [G.S.Das] Assistant Registrar (Court) CRM (M) 1157 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Chanditala PS Case No. 5 of 2026 dated 03.01.2026 u/s 117(2)/109/3(5)/303(2)/317(2) of the BNS read with section 11 of the Prevention of Cruelty to Animals Act adding Section 317(4)/317(5) of the BNS. -And- In the matter of : Beju Shaw @ Biju Shaw &Ors. … Petitioner(s) Ms. Sagnika Banerjee … for the Petitioner(s) Ms. Koel Mukherjee … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are innocent and have been falsely implicated in connection with the instant case as they were present in the vehicle. Learned advocate argues that charge-sheet has already been submitted but there is no possibility of the trial being concluded very soon. Learned advocate, as such, prays that the petitioners may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that the vehicle and its occupants were involved in lifting bulls/cows and when resisted ran over the injured. Learned advocate also canvassed that there are similar antecedents of these group of persons. 2 Having considered the nature of the offence being committed along with the previous antecedents, I am not inclined to enlarge the petitioners on bail at this stage. Hence, the prayer for bail of the petitioners is Rejected. However, the learned trial court is directed to take steps for overcoming the stage of consideration of charges. To that effect, if required, trial be split up. The trial court is also directed to ensure that the injured is examined as P.W.1 in the present case. The petitioners will renew their prayer for bail after the evidence of the injured is over. Accordingly, CRM (M) 1157 of 2026 is dismissed. Pending application(s), if any, is also disposed of.
