1. Let affidavit-of-service, as filed in Court, be kept on record.
2. In spite of service, there is no representation on behalf of any of the respondents.
3. The petitioner is employed as a Pharmacist in Correctional Homes.
4. The petitioner is aggrieved that he has not received the benefits, given to a part-time contractual Pharmacist engaged in different Homes by the order dated April 25, 2023.
5. Interestingly enough, the name of the petitioner features at serial no. 3 of the said order.
6. There is also a writ petition by the similarly situated persons being WPA 4768 of 2024, which was disposed of by an order dated May 7, 2024, directing the authorities to take a decision in respect of the part-time contractual Pharmacist in line with Memorandum dated September 16, 2011. Though the petitioner was not a party to the aforestated writ
2 petition, he is identically situated as the petitioners therein.
7. In fact, the petitioner had also made a representation on August 27, 2025, which is lying unattended.
8. In view of the aforestated, I direct the respondent no. 2 to consider the representation of the petitioner, in line with the order dated May 7, 2024, by which the impugned order of April 25, 2023 has already been modified, by October 31, 2026. The authorities will confer the benefit of the Memorandum dated September 16, 2011 and pay the differential amount as stipulated. Arrear shall be paid by November 30,
2026.
9. With the aforestated directions and observations, the writ petition is disposed of.
10. There will be no order as to costs.
11. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings. (Reetobroto Kumar Mitra, J.)
