The petitioners are members of Malihati Gram Panchayat and have assailed the notice of meeting issued upon them by the Prescribed Authority for consideration of applications submitted by the Pradhan of the Panchayat under Section 11(1)(d) of the West Bengal Panchayat Act, 1973. Learned counsel for the petitioners submits that no opportunity to show cause in terms of Section 11(1) of the Act was granted to the petitioners prior to fixing the date of meeting. This Court is informed that during pendency of the writ petition, notices to show cause have been issued upon the petitioners directing them to show cause by this day, that is, on 10th September, 2026 as to why they should not be removed from office in terms of Section 11(1)(d) of the Act. 2 The petitioners seek extension of the time to submit the show cause reply as well as adjournment of the meeting till such time. Since the show cause notices were served upon the petitioners on 8th September, 2026, the petitioners are granted liberty to reply to the same before the Prescribed Authority within seven days from date. The meeting fixed this day be postponed till submission of the replies by the petitioners. Upon receipt of such replies the Prescribed Authority shall fix a further date of meeting at the earliest. The gist of this order be communicated to the Prescribed Authority by the State at the earliest. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
