This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“....to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the in action on part of the respondents in not taking any actions on who cutting trees and ruin the Accreted and Coastal Regulation Zone (CRZ) Forest Lands situated boundaries in R.S.Nos.40, 41, 42, 45, and 47 of Neellaveru, H/o Brahmasamedyam, Katrenikona Mandal, Dr. B.R. Ambedkar Konaseema Dsitrict is illegal, arbitrary and in violation of Art. 14,19 and of the Constitution of India, consequently direct the respondents to Stop all illegal activities in the said Coastal Regulation Zone (CRZ) Forest Lands, take immediate steps to preserve the environment by conducting proper enquiry and take necessary action against the people who destroy nature …”
2. When the matter is taken up for hearing, Sri T.Sanjeeva Reddy, learned Assistant Government Pleader for Revenue brought to the notice of this Court that there is no such incident that came to the notice of the authorities about the cutting down the trees as alleged in the petition.
A Committee has been constituted to monitor this issue and they have been doing that. He would further submit that there is long standing disputes between the petitioner and one Sri M.Ravindra, President of Sri Rama Agnikula Kshtriya filed Labour Cooperative Society Limited. Therefore, this petition is filed by the petitioner objection to the cutting of the riped trees cultivated by the said M.Ravindra. 3. At this juncture, Sri T.S.N.Sudhakar, learned counsel for the petitioner seeks the permission of this Court to withdraw the present petition. 4. Permission is accorded. 5
