Learned advocate appearing for the petitioners submits that petitioners have been described to be associates of the principal accused and they are in custody for 98 days; charge-sheet has already been submitted. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the victim and other witnesses. I have taken into account the complicity of the present petitioners. Although the role of the present petitioners cannot be ignored, but further custodial detention of the petitioners after the charge-sheet has been submitted is also not called for. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Malay Barman @ Balai and 2. Dinabandhu Roy shall be released on bail upon
2 furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Dakshin Dinajpur at Balurghat. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Dakshin Dinajpur without prior permission of the learned Trial Court. Additionally, petitioners shall, till the charges are framed, stay outside the jurisdiction of Patiram Police Station. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1805 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
