And In Re : Soumalya Chowdhury ... Petitioner. Mr. Soumyajit Das Mahapatra, Ms. Madhurai Sinha, Ms. Upasana Banerjee, Mr. Bisal Roy ... For the Petitioner. Mr. Indradip Das, Mr. Shivam Mishra ... For the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about 13 months and was subsequently arrested. However, initially in the case from the other accused, 600 bottles of codeine mixture were recovered. Subsequently after the arrest of the present petitioner, another 25 bottles were recovered from a bush and it is stated that on the leading statement of the petitioner, such recoveries have been made. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as commercial quantity of contraband has been seized. State has submitted Memo of Evidence which reflects that there are three criminal antecedents of the present petitioner. Having regard to the antecedents of the present 2 petitioner and recovery being made on the leading statement of the petitioner, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1918 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
