Kausik (Allowed) CRM (A) 2969 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Paikar Police Station Case No. 174 of 2026 dated 08.06.2026 under Section 318(2)/318(3)/318(4)/338/336(3)/340(2)/61(2) of the BNS, 2023 and Section 3 & 4 of West Bengal Gambling and Prize Competition Act, 1957 and Section 7(3)/9 of Lotteries (Regulations) Act. And In the matter of : Aabdul Basar @ Kajol Sk. ……Petitioner. Mr. Prosenjit Mukherjee ……for the Petitioner. Ms. Arushi Rathore Mr. Uttam Basak ….for the State. Learned advocate appearing for the petitioner submits that on the basis of statement of the co-accused petitioner has been foisted with a criminal case with the accusation of involved in a fake lottery ticket business. Learned advocate for the State opposes the prayer for anticipatory bail. A specific query was made to the learned advocate appearing for the State as another accused Monirul Islam @ Septu Sk has been granted anticipatory bail in CRM (A) 2770 of 2026. So far as the case records are concerned according to the State, petitioner and Monirul Islam @ Septu 2 Sk are on the same footing. Having regard to the same, I am inclined to grant the privilege of anticipatory bail to the present petitioner also. As such, I direct that in the event of arrest, the petitioner, namely, Aabdul Basar @ Kajol Sk. be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioner shall report to the investigating officer within a period of 10 days and thereafter on all subsequent dates fixed by the investigating officer till the report in final form is submitted before the jurisdictional Court. Accordingly, CRM (A) 2969 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
