Learned advocate for the petitioner submits that although the subject-matter of the present case relates to alleged recovery of 73 bottles of Eskuf cough syrup but the present petitioner has been implicated only on the basis of statement of a co-accused. Learned advocate for the State opposes the prayer for anticipatory bail. However, on a specific query from the court, learned advocate for the State submits that neither the case records/Memo of evidence nor the police report do reflect
2 any previous antecedent and/or CDR and/or money trail of the present petitioner. Having considered the same, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Md. Soleman Sk] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2960 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
