JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 and 2 in Crime No.107/2026 registered by Chintamani Town Police Station, Chikkaballapura district for the offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 351(2), 352, 74, 324(4), 329(4), 190 of BNS 2023, are before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.107/2026 was registered by Chintamani Town Police Station, Chikkaballapura district for the aforesaid offences against Karthik and others, based on the first information dated 01.07.2026 received from Meghana A., who is the alleged victim in the present case. During the course of investigation, the petitioners herein were arrested on 02.07.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.205/2026 was rejected on 01.08.2026. Therefore, they are before this Court. - 3 - HC-KAR CNR: KAHC010558782026 NC: 2026:KHC:49682 CRL.P No. 12355 of 2026 4. Accused Nos.5 to 7 had approached this Court in Crl.P.No.12000/2026 seeking regular bail. The said petition was allowed on 10.08.2026. In paragraph No.4 of the said order, it is observed as follows: "4. Perusal of the material on record would go to show that in the first information, it is alleged that on 30.06.2026 at about 04.30 p.m., accused Nos.1 and 2 had intercepted the two wheeler of the alleged victim in which she was travelling and had misbehaved with her. Therefore, she allegedly had slapped them and informed about the said incident to her mother over phone. Subsequently, at about 08.30 p.m. on the same day, accused Nos.1 to 4 in the FIR and other persons came to the house of the first informant armed with weapons and after trespassing into the house, they allegedly abused the victim and her family members using filthy language. Subsequently, accused Nos.1 and 2 also assaulted the victim with weapons and other accused assaulted her with hands and also caused damaged to the property in her house". 5. Investigation of the case is now completed and charge sheet is filed. It is not in dispute that the petitioners herein do not have criminal antecedents. 6. Learned High Court Government Pleader submits has brought to the notice of this Court that the injured victim has suffered simple injuries in the incident in question. 7. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: - 4 - HC-KAR CNR: KAHC010558782026 NC: 2026:KHC:49682 CRL.P No. 12355 of 2026 O R D E R i) The Criminal Petition is allowed. ii) The petitioners are directed to be enlarged on bail in Crime No.107/2026 registered by Chintamani Town Police Station, Chikkaballapura district for the offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 351(2), 352, 74, 324(4), 329(4), 190 of BNS 2023, subject to the following conditions: a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- with one surety each for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
