And In Re : Biswajit Mondal @ Kunty Bishu ... Petitioner. Mr. Tapodip Gupta, Ms. Usashi Chattopadhyay, Mr. Golam Ahammed ... For the Petitioner. Mr. Madan Mohan Roy, Mr. Narattam Acharyya ... For the State. Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 135 bottles of codeine mixture and petitioner is in custody since 16.02.2026; charge-sheet has already been submitted before the jurisdictional court. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as commercial quantity of contraband was recovered from the present petitioner. Having considered the quantum of seizure referred to which is of commercial quantity, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of 2 the NDPS Act. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 1923 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
