09.09.2026 IN THE HIGH COURT AT CALCUTTA Item No.181 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (M) 1806 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Nagerbazar Police Station Case No. 236 of 2025 dated 23.10.2025 under Sections 109/118(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (G.R. Case No. 8163 of 2025). And In Re : Suman Banerjee @ Bagan Banerjee ... Petitioner. Mr. Jyotiraditya Mondal, Mr. Aditya Bikram Mahata, Mr. Shamik Chatterjee ... For the Petitioner. Mr. Amal Kumar Dutta, Mr. Rishav Kumar Singh ... For the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about ten months. Earlier the prayer for bail of the petitioner was rejected with a direction to approach this Court after the stage of consideration of charges is over. It has been informed on behalf of the petitioner and State that charges have already been framed. However, learned advocate appearing for the State opposes the prayer for bail. I have taken into account the period of detention of the petitioner which is about ten months. Having considered the same, I am of the opinion that further detention of the present petitioner in connection with the instant case is 2 unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Suman Banerjee @ Bagan Banerjee shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of North 24-Parganas without prior permission of the learned Trial Court. Additionally, petitioner shall not enter the jurisdiction of Nagerbazar Police Station till the evidence of vulnerable witnesses is over and report to the jurisdictional police station where he would be residing. The acknowledgement regarding the attendance to the local police station be furnished regularly before the learned Trial Court. The application for bail, being CRM (M) 1806 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
