ORAL ORDER
1. Petitioner and second respondent are present before the Court.

2. They submits a memo with a document styled as 'Mutual Compensation Consent Agreement'.
3. As per the terms of the agreement, necessary financial settlement has taken place in respect of death of Channakeshava being the lorry driver who lost his life in an unfortunate incident that occurred in the quarry on 16.09.2015 at about 12 noon.
4. Police after the receipt of the complaint, registered the case in Crime No.108/2025 under Sections 281 ands 106 of the Bharatiya Nyaya Sanhita, 2023 and Sections 180 and 181 of the Indian motor Vehicles Act,
1988.
5. After thorough investigation, charge sheet is also filed for the offences punishable under Sections 281, 106(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
6. Since the parties have settled the dispute amicably and the alleged offences has no serious impact

on the Society at large and privy to the parties, following the dictum of the Hon'ble Apex Court in the case of Ramgopal vs. State of Madhyapradesh reported in (2022) 14 SCC 531, pending proceedings needs to be quashed.
7. Second respondent present before the Court represented by Smt. Anuparana would submit that respondent No.2 has received the compensation from the petitioner.
8. Accordingly, following Order
ORDER
(i) Petition is allowed in view of the amicable settlement between the parties. (ii) Pending proceedings in CC No.22/2026 pending on the file of the Prl. Civil Judge and JMFC, Tiptur, Tumkur District for the offences punishable under Sections 281, 106(1) and 3(5) of the Bharatiya Nyaya

Sanhita, 2023 and Sections 180 and 181 of the Indian motor Vehicles Act, 1988 is hereby quashed.
