This matter is de-linked from the connected matters and separate order is passed.

The writ petition is filed by the petitioner, which is an Institution of speech and hearing, seeking for issuance of writ of mandamus or appropriate writ directing the respondent No.2 to depute its team of inspectors to conduct inspection of the physical infrastructure and other facilities, which would be in aid of renewal and approval to be granted insofar as academic year 2026-27 pursuant to the online Proposal IDs: ETEMPID-1234250710040024 and other consequential relief is sought for.

Learned counsel for the petitioner submits that the institute established in the year 2004 has been carrying on its activities and there have been approvals upto the year 2025-26. It is further submitted that the institute also has affiliation from respondent No.3 -

Bangalore University. It is further submitted that for the year 2026-27, requisite fees have been paid including fees for inspection. But, however, the 2nd respondent has not conducted inspection which has prejudiced the activities of the petitioner. It is further submitted that the requisite proposal online for the purpose of inspection and grant of approval has been made, but there is no action by the 2nd respondent.
4. Learned Central Government Counsel, Sri. Shrihareesh R. Kulkharni appearing for 2nd respondent submits that they would conduct an inspection as sought for in the prayer (a) and take a decision on approval and forward the same for necessary information to the 3rd respondent.

Learned counsel appearing for respondent No.3 submits that they are only in charge of affiliation and would take note of report to be sent by the 2nd respondent.

6. In light of stand taken by the 2nd respondent, it would be appropriate to dispose of the writ petition itself.

Learned counsel appearing for respondent No.2 submits that in the interregnum taking note of the nature of activities of the institution and also its involvement in training and education of professionals for speech and hearing, the Court may pass appropriate orders of permitting the institution to carry on admission for the year 2026-27, while putting the institution upon notice regarding decision on approval that would be taken in due course after inspection.
8. In light of the stand of the respondents and taking note of the prayer made, the petition itself is
disposed of. Respondent No.2 to conduct inspection as per procedure and applicable rules of the petitioner-institution, within a period not later than one (1) month from the date of receipt of certified copy of the order.

9. The order of approval is to be passed thereafter and same to be forwarded to respondent No.3 for its record. Upon the approval being forwarded to respondent No.3, counsel for respondent No.3 submits that they would take appropriate action regarding affiliation.

Learned counsel for respondent No.2 submits that the concession that they have agreed upon to permit the institute to make admissions would be followed up by the web-hosting regarding the provisional approval after the inspection
11. However, it is made clear that the process of approval and decision to be taken by respondent No.3, would have a bearing on the admission to be made by the petitioner. Accordingly, while the petitioner is permitted to carry out its admissions, same would be subject to orders of approval by respondent No.2 and affiliation by respondent No.3, which would be taken in due course.

12. In light of the above, the petition is disposed of.
