Affidavit-of-service filed on behalf of petitioner is taken on record. In spite of service of notice, respondent no.5 is not represented today. 2. Petitioner has prayed for direction upon the concerned police authority to take steps based on complaint dated 1st July, 2026 and it is submitted that petitioner is falsely implicated in connection with his employment. According to petitioner, his employer utilized his credentials and implicated him in an alleged cyber fraud case. 3. Mr. Billwadal Bhattacharyya, learned Additional Advocate General representing State respondents has filed a communication dated 10th September, 2026 of Officer-in-Charge, Hare Street Police Station, Kolkata and same is taken on record. 4. Said communication discloses that petitioner is one of the accused persons in Bidhannagar P.S. Case no.92 dated 28th April, 2025 and in connection therewith notice under Section 41A Cr.P.C/ Section 35(3) BNSS, 2023 was issued to the petitioner. In Bidhannagar P.S. Case no.92 dated 28th April, 2025 one Arup Kanti Das was allegedly induced to install some application [2] in his mobile and thereafter he was duped to the extent of ₹2,89,25,000/- . 5. Since there are allegations against petitioner that he is one of the accused in aforesaid criminal prosecution, it appears that in order to protect himself from impending steps to be taken by the concerned police authority, present writ petition is filed, which is afterthought. 6.
