HARI HARANADHA SARMA Tr.C.M.P.No.146 of 2026 Order: Notice sent to the respondent is served. 2. This petition is filed under Section 24 of CPC, with a prayer for transfer of F.C.O.P.No.2291 of 2021 from the Family Court, Visakhapatnam to the Family Court at Vijayawada. 3. The petitioner is the husband and the respondent is the wife of the petitioner. An application before the Family Court, Visakhapatnam was filed invoking Section 13 (1) (ia) (ib) of the Hindu Marriage Act, seeking dissolution of marriage on grant of divorce and the matter is under contest. 4. The learned counsel for the petitioner-husband claims that the matter is being adjourned without any progress and that the petitioner has to attend his business, which is shifted to Hyderabad from Vijayawada. Therefore, the matter, i.e., F.C.O.P.No.2291 of 2021 may be transferred from Visakhapatnam to Vijayawada. 5. It is relevant to note that even according to the averments in the affidavit, filed in support of the petition, the petitioner-husband has shifted his business from Vijayawada. It is not as if there are any other connected matters pending at Vijayawada. The only grievance of the petitioner is that the matter is not getting disposed, which is fairly submitted by the learned counsel 4 AHHS, J Tr.C.M.P.No.146 of 2026 for the petitioner. There are no tenable grounds found for transfer of F.C.O.P.No.2291 of 2021 from the Family Court, Visakhapatnam to the Family Court at Vijayawada. 6. For the above said reasons, this Transfer Civil Miscellaneous Petition is dismissed. However, the petitioner is at liberty to make an appropriate application before the learned Judge, Family Court, Visakhapatnam, where the matter is pending, for expeditious disposal of the matter and the learned Judge, Family Court, Visakhapatnam, may consider it as per law and convenience. The respondent shall co-operate for the same. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed. _____________________________ A.
