JUSTICE E.S.INDIRESH - 3 - HC-KAR CNR: KAHC010226082025 NC: 2026:KHC:49745 WP No. 11378 of 2025 ORAL ORDER In this petition, petitioner sought for a direction to respondent No.3 to consider the application dated 14.01.2019 (Annexure-A), inter - alia sought for a direction to respondent No.4 to take a decision in the matter as to the preparation of the missing records. 2. Having heard the learned counsel appearing for the parties, in identical situation in WP No.10659/2025, disposed of on 11.08.2026, this Court at paragraphs-5 to 8 held as follows. "5. Upon careful consideration of the submissions made by the learned counsel appearing for the parties and the letter dated 17.12.2021 (Annexure-E1), whereby Respondent No. 5 addressed a letter to Respondent No.3 to prepare the records pertaining to the subject land based on the list furnished therein. It is evident that Respondent No. 5 had directed Respondent No.3 to prepare the necessary - 4 - HC-KAR CNR: KAHC010226082025 NC: 2026:KHC:49745 WP No. 11378 of 2025 documents/records in accordance with the list provided. 6. A perusal of Annexure-E1 dated 17.12.2021 would further indicate that Respondent No. 5 had addressed the said letter to Respondent No. 3 for preparation of the missing records pertaining to the subject land. In that view of the matter, it is the duty of Respondent No. 3 to prepare the missing records pertaining to the land in question within an outer limit of six months from the date of receipt of a certified copy of this order. 7. In view of the above, the reasons assigned in the Endorsement dated 01.02.2025 (Annexure-G) issued by the respondent No.5- Thasildar cannot be accepted. Accordingly, the said Endorsement is quashed. 8. It is also open to the petitioner to furnish any documents that may be necessary to enable Respondent No. 3 to prepare the missing records, if the same is required." - 5 - HC-KAR CNR: KAHC010226082025 NC: 2026:KHC:49745 WP No. 11378 of 2025 3. In that view of the matter, taking into consideration the grievance addressed by the petitioner, respondent No.3 is directed to prepare the missing records at the earliest, and thereafter, take a decision in the matter, in accordance with law. It is also open for the petitioner to furnish any further documents that may be necessary to enable the respondent No.3 to prepare the missing records.
