1. The petitioners complain of inaction on the part of the CESC Authorities in transferring the existing connection in favour of the petitioners. 2. The earlier order dated September 1, 2026 has recorded the bone of contention between the parties in the following way:
“3. It is submitted that the petitioners are purchasers of the subject property from the erstwhile owner thereof, who had two electricity supplies in their respective names. The petitioners say that the said supplies may be transferred in the names of the petitioners without the petitioners being required to apply for fresh electricity connection. 4. Mr. Halder, learned advocate appearing for the petitioners, however, submits that although, the petitioners had initially applied for transfer of the electricity supply in their favour, subsequently, the petitioner no.1 has also applied for fresh electricity supply in his own name. 2

Mr. Mukherjee, learned advocate appearing for the respondent CESC authorities submits that change of name of the registered consumers can only be done if the erstwhile registered consumers consent to such change. It is submitted that the erstwhile registered consumers have applied for disconnection of the existing electricity supply and, as such, the petitioners’ request for transfer of the electricity supply in their favour cannot be acceded to till such time the petitioner brings a no objection from the registered consumers at the subject property. 6. Mr. Halder submits that the petitioners would not have any objection if instead of transferring the supply in favour of the petitioners, a fresh/new supply is granted to the petitioners. However, the petitioners are apprehensive that if for the purpose of effecting fresh supply in favour of the petitioners, the supply existing in the name of the registered consumers (i.e. the erstwhile owner of the premises) is disconnected, the petitioners would have to live in the dark till such time that a fresh connection is effected. 7. Since the petitioner no. 1 has already applied for a fresh/new electricity supply in his own name, therefore, the CESC Limited may explore the possibility of simultaneous disconnection and grant of fresh connection in favour of the petitioner no.
1 so as to allay the petitioners’ fear of having to live without electricity for a certain period of time.”
3. Mr. Mukherjee, learned advocate appearing for the CESC Authorities, submits, on instructions today that the petitioners’ apprehension can be allayed by supplying electricity to the petitioners by installing a meter immediately upon the disconnection of the
3 existing supplies provided all formalities are complied with and payment in respect of the new connection is made by the petitioners. 4. It is further submitted that the petitioners must not raise any objection against the CESC Authorities’ removing the meters in respect of the existing supplies which are to be disconnected. It is further submitted that since the petitioners have admittedly been enjoying electricity from the existing supplies that would be disconnected, for the purpose of effecting a new supply in favour of the petitioners, the petitioners must also clear the outstanding dues in respect of the existing supplies, if any, prior to getting the new supply and meter. 5. Mr. Halder, learned advocate appearing for the petitioners, submits that the petitioners are ready and willing to clear the outstanding dues in respect of the existing supplies, if any, and the petitioners would not have any objection to CESC Authorities removing the old meters. 6. The dispute between the parties appears to have been resolved, as would be evident from the submissions made on their behalf and nothing further remains to be adjudicated in this writ petition. 4

Accordingly, it is directed that upon the petitioners complying with all necessary formalities and paying requisite charges, the CESC Authorities shall issue a notice to the petitioners for the purpose of executing the job of disconnecting the two old supplies and effecting a new supply in favour of the petitioners on the same date subject to the conditions that the petitioners would clear the outstanding dues, if any, in respect of the two old supplies and they would not object to the removal of the old meters. 8. With the aforesaid observations, WPA 22577 of 2026 stands disposed of. There will be no order as to costs. 9.
