The petitioner complains of inaction on the part of the respondent WBSEDCL authorities in not effecting electricity supply in favour of the petitioner despite there bring a direction given by the Civil Judge, (Senior Division), 2nd Court, Hooghly in such regard in Title Suit No. 237 of 2025. 2. The petitioner contends that the learned Civil Judge Court had passed an order on September 10, 2025 observing that the petitioner (plaintiff) may pursue installation of a sub-meter at her parental residence ‘to ensure lawful supply of electricity’. It is submitted that despite such order having been passed the WBSEDCL authorities have not effected electricity supply in favour of the petitioner. 3. Mr. Chattopadhayay, learned advocate appearing for the WBSEDCL authorities submits that the distribution licensee is not a party to the suit. It is further submitted that installation of sub-meter
2 does not fall within the preview of the WBSEDCL authorities inasmuch as they install meters (and not sub-meters) upon the applicant being found entitled to supply of electricity. 4. It is further submitted that no application for connection of electricity has been made by the petitioner as yet. 5. Mr. Sur, learned advocate appearing for the respondent nos. 4 and 5 submits that a suit for partition has been filed by the petitioner against the other co-shares in respect of the said property and that excepting the respondent nos. 4 and 5, the other co-shares have not added as a party. 6. Heard the learned advocates appearing for the respective parties and considered material on record. 7. It is evident that the petitioner is yet to make any application for grant of electricity connection in her favour at the relevant premises. Since no application has been made, there is no cause for the WBSEDCL authorities to act thereon. 8. The order dated September 10, 2025 passed by the learned Civil court grants liberty to the petitioner to approach the WBSEDCL authorities in accordance with law.
The petitioner would therefore have to first approach the authority for the purpose of taking electricity supply in accordance with law. 3
9. If such application is made there no reason why the WBSEDCL authorities would not take appropriate steps either granting or rejecting the petitioner’s application in accordance with law
10. In view of the aforesaid facts, no further order needs to be passed with the writ petition WPA 23685 of 2026 stands disposed of. No Costs. 11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
