Mattegunta.Sudhir,Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats The Court made the following: 4 SRK, J WP.No.25254 of 2025 O R D E R The present Writ Petition is filed seeking the following relief:- “…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondents in seeking to lay road through the petitioner's land admeasuring Ac.0.25 cents in Sy No. 453-M of Uravakonda Village and Mandal, Ananthapuramu District, as illegal, arbitrary, without jurisdiction, violative of Articles 14, 21 and 300-A of Constitution of India and violative of principles of natural justice and to consequently direct the Respondents not to interfere with the possession and enjoyment of the petitioner over the above property and not to lay road in the above land and pass such other order”. 2. Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Panchayat Raj and Rural Development and the learned Standing Counsel for Gram Panchayat. 3. The case of the petitioner, in brief, is that he is the owner and possessor of land admeasuring Ac.0.25 cents in Survey No.453-M of Uravakonda Village and Mandal, Ananthapuramu District. Originally, the said property belonged to the petitioner's great-grandfather, Ramappa, who purchased it vide Document No.52/1946, dated 11.01.1946. Thereafter, the property devolved upon the petitioner by virtue of a registered Will Deed dated 26.09.1988, bearing Document No.29/1988, and the petitioner has been in peaceful possession and enjoyment of the said property. While the matter stood thus, Respondent No.3, allegedly for extraneous considerations, came to the petitioner's land on 13.09.2025 and dumped cement bags and other construction material with a view to laying a road through the petitioner's property. It is further averred that certain local political leaders exerted pressure on Respondent Nos.3 and 6 to proceed with the laying of the road through the land belonging to the petitioner. 4. Respondent No.3 filed a counter-affidavit denying the allegations made in the writ affidavit. It is categorically stated therein that the Gram Panchayat has never attempted to lay a road through the petitioner's land. According to 5 SRK, J WP.No.25254 of 2025 the respondents, it was the petitioner's neighbours, who laid a pathway for their own ingress and egress. It is further stated that the Gram Panchayat has never interfered with the petitioner's land at any point of time. 5. A perusal of the counter affidavit reveals that the Gram Panchayat has categorically asserted that it has neither evinced any interest in laying a road through the subject land nor attempted to interfere with the same at any point of time. The petitioner filed I.A. No.2 of 2025 seeking a direction to the respondents to forthwith restore possession of the petitioner's land admeasuring Ac.0.25 cents in Survey No.453-M of Uravakonda Village and Mandal, Ananthapuramu District. Once the respondents have specifically asserted in their counter affidavit that the authorities have neither attempted to lay a road in, nor interfered with, the petitioner's property, the question of issuing a direction to the respondents to restore the property to the petitioner does not arise. However, it is always open to the petitioner to avail such other remedies as may be available to him in accordance with law. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. _____________________________ JUSTICE K.
