1. Learned advocate appearing for the petitioners submits that petitioners are the distant relatives of the victim. He came to Kolkata for attending marriage ceremony at the house of the principal accused. The victim was set ablaze by the principal accused and others. He also submits that the petitioners are in no way connected to the incident. He prays for anticipatory bail.
2. On the other hand, learned advocate for the State relies upon the materials in the case diary including dying declaration recorded by the victim. He opposes the prayer for anticipatory bail.
3. The instant case is under Section 103(2)/351(2)/61(2)(b) of BNS.
4. Considering the materials in the case diary as well as the post mortem report, the investigation of the case is yet to be concluded.
2 There are allegations of putting the victim ablaze by pouring kerosene. The victim was admitted in hospital and in course of treatment, he succumbed to his injuries.
5. Considering the materials in the case diary as well as the gravity of the offence, I am not inclined to grant anticipatory bail to the petitioners.
6. Accordingly, the application for anticipatory bail is rejected.
7. CRM(A) 2544 of 2026 stands disposed of.
8. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
