Sankar Achariya Mr. Souma Subhra Roy Ms. Neelam Kumari Mr. Swagata Santra …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division) 1st Court at Barasat to dispose of Title Suit No. 229 of 2021 expeditiously. Learned advocate appearing for the petitioner submits that an application under Order 6 Rule 17 of the Civil Procedure Code filed by the petitioner is pending. She submits that April 28, 2027 is fixed for hearing of the application under Order 6 Rule 17 of the Civil Procedure Code. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. In the light of the submission made by the learned advocate appearing for the petitioner this civil revision application stands disposed of by requesting 2 the learned Civil Judge (Jr. Division) 1st Court at Barasat to take up the hearing of the application under Order 6 Rule 17 of the Civil Procedure Code on the next date fixed, if the same is otherwise ready for hearing and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the said application and any other interlocutory application that may be pending, the learned trial judge shall make an endeavour to dispose of the suit as expeditiously as possible. Considering the fact that the next date for hearing the application under Order 6 Rule 17 of the Civil Procedure Code is fixed sometime in April, 2027, it will be open to the petitioner to approach the learned trial judge for proponing the next date of hearing of the application. If such an application is made, the learned trial judge shall consider the same and dispose of the same in accordance with law. (Hiranmay Bhattacharyya, J.)
