The present intra Court appeal has been filed impugning the judgment and order dated 28.02.2025 passed by the writ Court in W.P.No.22574/2019 (S-RES) and other connected writ petitions, instituted by the appellant.
2. Writ petitions were filed by the Appellant-Sri Bidrambika Education Society (for brevity 'the Society') challenging the
order passed by the Educational Appellate Tribunal by which the Tribunal had set aside the order of termination passed by the Management against four of its non-teaching staff and
directed the appellant to reinstate them on their original posts and pay arrears and salary from the date of their suspension till the date of reinstatement with all consequential benefits.

There can be no dispute that the enquiry conducted by the Managing Committee against the four non-teaching employees was in violation of Rule 28(4) of the Karnataka Pre-University Education (Academic, Registration, Administration and Grant-In Aid Etc) Rules 2006 framed in exercise of the powers conferred under Section 145(1) of the Karnataka Education Act, 1983. Under Rule 28(4) whenever the enquiry is proposed by the Managing Committee, then the Enquiry Officer would have to be a serving or retired Government Servant or a Legal Practitioner and the Enquiry Officer is to be appointed by the Director of the Education, who should submit the report to the Director, who would thereupon send it to the Managing Committee.
3. In this case, the rules have been violated in conducting the disciplinary enquiry against the four employees. The
learned counsel appearing for the appellant does not dispute the findings on law and facts of the writ Court.
4. Therefore, we find no ground to interfere with the well reasoned judgment and order dated 28.02.2025 passed by the

learned Single Judge impugned in this writ appeal, which is why we dismiss this appeal, however, without costs.
