1 CGHC010350032026 2026:CGHC:44061 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8809 of 2026 1 - Rajesh Jangde S/o Agatram Jangde, Aged About 26 Years R/o Village Balsi, Police Station Saraipali, District Mahasamund (C.G.) ... Applicant versus 1 - State Of Chhattisgarh Through The Station House Officer, Police Of Police Station Saraipali, District Mahasamund (C.G.) --- Non-applicant For Applicant : Mr. Ajay Kumar Chandra, Advocate For Non-applicant : Ms. Priya Shrama, PL Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 12.10.2026 1) The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.233/2026 registered at Police Station Saraipali, District Mahasamund (C.G.), for the offence punishable under Sections 296, 351(2), 115(2) & 109(1) of BNS. 2) The prosecution case, in brief, is that on 16.07.2026, due to a land dispute, the applicant allegedly assaulted the complainant and his son with a spade, causing injuries, and injured the wife of the complainant by hitting her with a piece of brick. All three were taken to Saraipali Government Hospital for treatment. The applicant was arrested on 18.07.2026. Hence, the present bail application. 2 3) Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in the present case due to previous enmity between the complainant and the applicant. He would further submit that the applicant has only one criminal antecedent, registered in the year 2022, the charge-sheet has already been filed and the applicant is in jail since 18.07.2026. Therefore, he prays for grant of regular bail to the applicant. 4) On the other hand, learned State counsel opposes the bail application and submits that the applicant allegedly assaulted Avadhram and Ramesh with a spade and injured Rajmati with a piece of brick. He would contend that Avadhram sustained lacerated wounds on his back and left leg, along with another injury on his jaw, whereas the injuries sustained by Rajmati and Ramesh were simple in nature. Though the injuries sustained by Avadhram were not life-threatening but the nature of the allegations and the use of a spade in the incident cannot be overlooked. Accordingly, she prays for rejection of the bail application. 5) I have heard learned counsel appearing for the parties and perused the case diary. 6) Having considered the submissions made by learned counsel for the parties and the facts and circumstances of the case, particularly that the applicant allegedly assaulted the complainant and his family members due to a land dispute, Avadhram sustained lacerated wounds on his back and left leg, along with another injury on his jaw, whereas Rajmati and Ramesh sustained simple injuries. However, as per the medical report, the injuries sustained by Avadhram were not life-threatening. Further, the charge-sheet has already been filed, the applicant is in jail since 18.07.2026, and the only criminal antecedent against him was registered in the year 2022. Considering the overall facts and circumstances of the case, the nature of the injuries sustained by the injured persons, the period of detention undergone by the applicant, and the completion of the investigation, I am 3 inclined to grant bail to the present applicant. Accordingly, the bail application is allowed. 7) It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. The observation made hereinabove is for the purpose of deciding this bail application only, the learned trial Court shall decide the case on its own merits. Sd/- (Rakesh Mohan Pandey) JUDGE Rekha
