Accused in Crime No.159/2026 registered by Koratagere Police Station, Tumakuru, for the offences punishable under Sections 132, 121(2), 352 and 351(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.159/2026 was registered by Koratagere Police Station, Tumakuru, for the aforesaid offences against petitioner herein based on the first information dated 20.07.2026 received from Vinod M H, police constable attached to Koratagere Police Station. In the said case, petitioner was arrested on 20.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5270/2026 was rejected on 05.08.2026. Therefore, he is before this Court. 4. A reading of the first information would reveal that on the alleged date of incident, Koratagere Police had received - 3 - HC-KAR CNR: KAHC010588062026 NC: 2026:KHC:50062 CRL.P No. 13138 of 2026 information that petitioner was abusing his wife Kavya and his father Hanumantharayappa near his house. Therefore, Koratagere police went near the house of the petitioner and tried to pacify him. It is alleged that petitioner took objection for the same and he abused the police constables, who had arrived near his house and also caught hold of their shirt color. It is in this background, FIR was registered against the petitioner. Petitioner, who has no other criminal antecedents, is in custody in the present case for the last about 50 days. Major portion of the investigation is already completed. Considering the nature of allegations found in the first information and also background in which the alleged incident had taken place, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.159/2026 registered by Koratagere Police Station, Tumakuru, for the offences punishable under Sections 132, 121(2), 352 and 351(2) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the - 4 - HC-KAR CNR: KAHC010588062026 NC: 2026:KHC:50062 CRL.P No. 13138 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
