IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION Appellate Side Ct. No.4 D/L 11.09.2026 (Naba) 04 W.P.S.T. 174 of 2026 Samit Jamadar Vs. The State of West Bengal & Ors. Mr. Sankar Dalapati, Mr. Kapil Ch. Saha ...for the Petitioner Ms. Chandreyi Alam, ld. A.G.P., Ms. Runu Mukherjee ...for the State 1. Heard the learned advocate for the petitioner and the learned State advocate. 2. The present writ petition arises out of an Original Application bearing O.A. No. 179 of 2025. The O.A. itself was filed when The West Bengal Administrative Tribunal (‘Tribunal’ for short) was non-functional. If the Tribunal was non- functional, the petitioner’s remedy was before the Writ Court (Single Judge Bench) dealing with the determination of service matters. 3. The learned advocate for the writ petitioner, thus, submits that he will avail the remedy in accordance with law. 4. In view of the above circumstances and submissions, we grant liberty to the petitioner to approach the Single Judge Bench for the self- 2 same relief after giving an undertaking that the petitioner will withdraw the Original Application bearing O.A. No. 179 of 2025 pending before the Tribunal. 5. The Writ Petition is disposed of in the above terms. (Madhuresh Prasad, J.) (Partha Pratim Roy, J.)
