Mr. Kallol Guha Thakurata, learned advocate is directed to represent the private opposite party as he is empanelled with the High Court Legal Aid Services Authority. His appearance be regularized by the concerned authorities. Mr. Jha, learned advocate for the State opposes the prayer for anticipatory bail. 2
I have taken into account the statement of the victim under Section 183 of the BNSS. Pursuant to the investigation commencing, there has been change of circumstances. The tenor of the statement under Section 183 of the BNSS do reflect different state of affairs which do not satisfy the concerns of the Court to send the present petitioner in custody. As such prayer for anticipatory bail of the petitioner is allowed. As such, I direct that in the event of arrest, the petitioner, namely, Sahid Hossain @ Sahid Hasan be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress petitioner shall report to the investigating officer within a period of 10 days and thereafter on all subsequent dates fixed by the investigating officer till the report in final form is submitted before the jurisdictional Court. With the aforesaid observations CRM (A) 2971 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
