JUSTICE C.M. POONACHA ORAL ORDER The present writ petition is filed seeking for the following reliefs:- "a. Issue a Writ of Certiorari or any other writ quashing the tender Notification bearing tender No.DME/2025-26/SEO670/Call-2, dated 2.06.2026 called out by the Respondent No.7 for providing Ward attender Services to Trauma Care Center (TECC), Victoria Campus, Bengaluru which is at Annexure-A. Issue a Writ of Certiorari or any other writ quashing the tender Notification bearing tender No.DME/2025-26/SEO669/Call-2, dated 22.06.2026 called out by the Respondent No.7 for providing Housekeeping Services, to Trauma Care Center (TECC) Victoria Campus, Bangalore which is at Annexure-B. c. Issue a Writ of Certiorari or any other writ quashing the tender Notification bearing tender No.DME/2025-26/SE0671/Call-2, dated 22.06.2026 called out by the Respondent No.7 for providing Security Services to Trauma Care Center (TECC) Victoria Campus, Bengaluru, which is at Annexure-C. d. Issue a Writ or any other nature of Writ or order or direction and grant such other relief in favour of the Petitioner as deem fit in the circumstances of the case in the ends of justice and equity". 2. Although various reliefs are sought in the present writ petition, learned counsel for the petitioner submits that the petitioner is aggrieved by the corrigendum dated 07.07.2026 (Annexure-V to the writ petition) whereunder the 2nd respondent has stipulated that in the event of there being more than 1 bidder as "L-1", the Bidder offering the highest performance security deposit above the stipulated 5% would be considered for award of the contract. Learned counsel for the petitioner further submits that vide the corrigendum dated 30.06.2026 (Annexure-S to the writ petition), the stipulation that in the case of more than one bidder, be has "L-1", the bidders scoring the highest marks in the Quality and Cost Based Selection (QCBS) will be awarded to the contract was issued prior to the impugned corrigendum dated 07.07.2026 which was just and proper. 4. The Learned counsel for the respondents on instructions submits that in the event of there being more than 1 bidder as L-1, the evaluation of the bids would be in terms of the corrigendum dated 30.06.2026 (Annexure- S to the writ petition). It is further submitted that the corrigendum dated 07.07.2026 (Annexure-V to the writ petition) insofar as it stipulates regarding the evaluation of the technical tender is contrary to the provisions of the Karnataka Transparency in Public Procurements Act, 1999 and hence the same be quashed by this Court. In view of the submissions made by both the learned counsels, the corrigendum dated 07.07.2026 (Annexure-V to the writ petition) insofar as it relates to the evaluation of the technical tender is hereby quashed. 6. The evaluation of the tenders which are the subject matter of the present writ petition with regard to the consideration of the same if more than one bidder is "L-1", shall be done in terms of the corrigendum dated 30.06.2026 (Annexure-S to the writ petition). 7.
