Chowdhury Mr. Romit Nag ….Advocates 1. The petitioner participated in the West Bengal Joint Entrance Examination and he intends to seek reservation under the EWS category. As per his ranking in the merit list he got selected in the Electrical Engineering Branch. His choice of subject is, however, Computer Science. There were two vacancies in Computer Science which got filled up and the rank of the petitioner being eleven; he did not get a chance to study Computer Science. 2. The petitioner submits that there are total 120 seats in the Computer Science course and if the mandatory ten percent reservation in the EWS category candidates is allowed, then the petitioner will get the chance to get admitted in Computer Science. 3. Prayer has been made to direct the respondents to permit the petitioner to be admitted in the subject Computer Science. Page 2 4. Learned advocate representing the Jadavpur University relies on the report filed and submits that the admission process is of the year 2024-25. The classes have started long back. The Faculty Council of UG&PG Study in Engineering and Technology, Jadavpur University conducted emergency meeting and decided to fix the number of seats in respect of each course. 5. In respect of Computer Science and Engineering only two seats were reserved for EWS category for which the petitioner could not get the chance to be admitted. He has already been admitted in the subject Electrical Engineering. 6. It has also been submitted that there is hardly any scope to permit shifting of streams in the mid-session. Moreover, accommodating the petitioner would mean that there are candidates from the roll numbers 3-10 who did not get a chance to be selected in the EWS category. 7. After hearing the submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that, the admission process of the particular year concluded long back. The classes for the first year are nearly over. The petitioner is ranked eleven in the EWS category and admission has been allowed in respect of only first two candidates. Rest could not be accommodated in the EWS category. 8. Allowing the prayer of the petitioner, after completion of nearly one year of the academic session, even though he stands at a lower rank, will not be proper. 9. The petitioner submits that he took admission under the EWS category in a different subject, but thereafter he discontinued the same as the course is not according to his choice. The petitioner has Page 3 expressed that he is a meritorious candidate and may be selected in other course in future. 10. The prayer of the petitioner in the instant writ petition cannot be allowed. It will be open for the petitioner to pursue his education and try to get admitted in any course or college according to his choice and merit. 11. In view of the above, no relief can be granted to the petitioner in the instant writ petition. The writ petition and the connected application are hereby dismissed. 12.
