JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed by the petitioners who are employees of the Transport Department calling in question the Government Order at Annexure-A. 2. It is not in dispute that for the purpose of promotion to the post of Inspector of Motor Vehicles, certain additional qualifications are required which include Diploma in Automobile Engineering. The petitioners are stated to have obtained such diploma which is contested. In the context of inquiry into the Degree obtained in the nature of Diploma in Automobile Engineering, a Three-man Committee was constituted, which has also opined for further enquiry. - 5 - HC-KAR CNR: KAHC010534082026 NC: 2026:KHC:49665 WP No. 24150 of 2026 3. The order of 10.03.2026 which is assailed, relates to an order constituting an enquiry by a retired District Judge. Admittedly, the enquiry relates to the certificates obtained for completion of courses. Such aspect would have a direct bearing on the right of promotion. If that were to be so, that would be a service matter as contemplated under Sections 3(p) and 3(q) of the Administrative Tribunals Act, 1985. 4. If that were to be so, in the absence of "unprecedented extraordinary situation having no parallel", the Court declines to entertain the writ petition and the petitioners are relegated to initiate appropriate proceedings before the Tribunal, which provides for substantive mode of redressal of their grievance, relating to service matters. 5. If the petitioner were to file appropriate application before the Tribunal, the time spent before this Court may be taken note of appropriately, in the event any question of limitation arises. - 6 - HC-KAR CNR: KAHC010534082026 NC: 2026:KHC:49665 WP No. 24150 of 2026 6. As it is stated that there was an interim order before this Court, the interim order would stand extended for a period of three (3) weeks from today. It is made clear that the Tribunal may not be influenced by the protection granted herein, as the same is without final adjudication. Such protection is granted in light of the apprehension of the petitioners stating that pursuant to the impugned order, they apprehend further action which may affect their continuation in service. 7. Accordingly, the petition is disposed of. All contentions are kept open. Registry to return back all original and certified copies of the documents. 8.
