Affidavit-of-service filed today is kept on record. 2. The subject matter of challenge in the writ petition is a memo dated November 27, 2025 issued by the Executive Engineer of Murshidabad Municipality addressed to the writ petitioner with regard to the initiation of disciplinary proceeding as per provision of the West Bengal Municipal Employees’ (Classification, Control, Appeal and Conduct) Rules, 2010. 3. Learned counsel appearing for the municipal authorities in his usual fairness submits that the memo was issued by bona fide mistake and the same is not tenable. 4. Accordingly, the memo dated November 27, 2025 being Annexure-P7 to the writ petition is set aside. 5. However, the municipal authorities shall be at liberty to take appropriate steps according to the law in respect of the subject matter in question. 6. WPA 28671 of 2025 is disposed of. 7. There will be no order as to costs. 2 8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
