ORAL ORDER
1. Accused in Crime No.211 of 2026 registered by Maddur Police Station, Mandya District for offences punishable under Sections 351(2), 118(1), 109(1) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.211 of 2026 was registered by Maddur Police Station, Mandya District for the aforesaid offences against the petitioner, based on the first information dated 17.06.2026 received from Smt. Sukanya, who is the mother of the victim girl and apprehending arrest in the case, petitioner had filed Crl.Misc.No.606 of 2026 which was rejected on 09.07.2026. Therefore, he is before this Court.

Learned counsel for the petitioner having reiterated the grounds urged in the petition submits that the petitioner had earlier approached the jurisdictional Police on 14.03.2026

alleging that injured victim Gagan was misbehaving and causing threat to his family. Therefore, Gagan was summoned by the police and he had undertaken not to continue his act. It is in this background, the alleged incident had taken place. The petitioner who has no other criminal antecedents is a married man. Accordingly, he prays to allow the petition.

Per contra learned HCGP, who has opposed the petition submits that the victim aged 22 years has suffered five injuries in the incident in question, out of which, four injuries are certified as grievous injuries. Injured was in hospital for a considerable period of time. The petitioner has not cooperated for the investigation. The weapon used to commit offence is yet to be recovered. Accordingly, he prays to dismiss the petition.
6. Perusal of the material on record would go to show that, the family of the victim and the family of the petitioner are residing in adjacent houses. It appears that, father of the victim was constructing a new house and there was a dispute between the two families with regard to the same. It is in this background, on 17.06.2026 at about 05.30 p.m., petitioner

after quarrelling with the victim had assaulted him with a knife on his neck and other parts of the body. As a result of the said assault, Gagan has suffered five injuries and his wound certificate would go to show that, 4 out of the 5 injuries are certified as grievous injuries by the medical officer who has issued the wound certificate. Injury caused to the victim are on the vital parts of his body and the same is caused by a deadly weapon by the petitioner. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail cannot be entertained.
7. Accordingly, criminal petition is dismissed.
