09.09.2026 Item No11 Ct. No. 1 RP FMA 1117 OF 2026 WITH IA NO.CAN 1 OF 2026 SATINATH GOSWAMI Vs STATE OF WEST BENGAL & Ors. Mr. Pratip Kumar Chatterjee, Sr. Adv. Ms. Ipsita Ghosh ….. For the Appellant Mr. D.N. Ray, Ld. GP Mr. Guddu Singh Mr. S. Halder …..For State 1. Affidavit-of-Service filed in Court today, be taken on record. 2. We have heard the learned counsel for the Appellant for quite sometime. We have gone through the Memo of the Appeal. We have considered the record placed before us. We have also considered the earlier orders passed by the learned Single Judge dated 21.02.2025 in WPA 3160 of 2025 and by the learned Division Bench dated 27.07.2026 in WPA 15725 of 2026. 3. We find that the dispute between the Petitioner and Respondent nos.7-15, is purely a Civil dispute regarding the agricultural land. 4. The learned Advocate for the Petitioner submits on instructions that the Petitioner would approach the Civil Court and seek appropriate direction, including perpetual injunction against those offending his rights qua his agricultural land. 5. In view of the above, this Petition and the connected Application are disposed off as withdrawn on instructions. If the Petitioner approaches the Civil Court and seeks redressal of his grievances, all contentions of all the litigating parties are kept open. 6. Insofar as the earlier direction of this Court is concerned, the same shall be taken into account by the concerned authorities, as well as by the Civil Court. (Tapabrata Chakraborty,J.) (Ravindra V. Ghuge, CJ.) 2
