MANIK LAL YADAV Counsel for the Respondent(S): 1. 3 The Court made the following ORAL ORDER: The present C.R.P is filed challenging the order dated 20.06.2017 in I.A.No.497 of 2017 in O.S.No.101 of 2016 passed by the Civil Judge (Junior Division), Kanigiri. I.A.No.497 of 2017 is filed under Order 26 Rule 9 C.P.C. After hearing both counsels, the trial Court had dismissed the said IA on the ground that the petitioner/defendant is not in possession of the isthifa document. The appointment of Advocate Commissioner is only collection of physical features but not for collection of evidence to examine the revenue authorities. 2. It transpires from the record that on 25.06.2026 there is no appearance on behalf of the petitioner. Therefore, this Court had directed the Registry to list this matter for dismissal. Even today, none appears for the petitioner. It also transpires that on 08.11.2017, when this matter was coming before this Court for admission, none appeared for the petitioner. It appears that the petitioner did not evince any interest to prosecute this case. 3. Accordingly, this Civil Revision Petition is dismissed as infructuous. No order as to costs. Registry is directed to transmit a copy of this order to the Court below to enable the trial Court to dispose of the suit bearing O.S.No.101 of 2016 on the file of Civil Judge (Junior Division), Kanigiri, as early as possible, if the suit is pending. 4.
