The revisional application has been preferred by the wife/petitioner praying for transfer of Act VIII Case No. 229 of 2025 under Section 24 of the Code of Civil Procedure from the Court of learned District & Sessions Judge, Alipore, South 24 Parganas to the Court of learned District & Sessions Judge at Howrah. 4. It is the case of the petitioner/wife that she resides with her minor child of 13 years at 1st Floor, 8, Rameswr Malia Lane, PO & PS & District – Howrah, PIN 711 101. 5. On the other hand the husband/opposite party resides at Matri Icon, Flat No. 404, Block B, Plot No. 35/36, Sector 19, 2 2 Kharghar, Navi Mumbai, District – Raigad, Maharashtra, PIN 410 210. 6. On hearing the learned counsels for both the parties and also on considering that the ordinary place of residence of the child is at Howrah, this Court relying upon its order dated 27.03.2026 passed in CO 4128 of 2024, Shantilal Sharma v. Susant Vyas @ Sushanta Vyas & Ors., directs that Act VIII Case No. 229 of 2025 be withdrawn from the Court of learned District & Sessions Judge, Alipore, South 24 Parganas and be transferred to the Court of learned District & Sessions Judge at Howrah. 7. Learned District & Sessions Judge at Howrah shall proceed with the suit in accordance with law with due notice upon both the parties. 8. Keeping in mind the case of the opposite party herein, the learned District & Sessions Judge at Howrah shall be at liberty to permit the opposite party to appear virtually, if the such prayer is made. 9. CO 1776 of 2026 is disposed of. 10. Connected application is also disposed of. 11. Parties to act on the server copy of this order. 3 3 12.
