The petitioner complains of inaction on the part of the respondent WBSEDCL Authorities in effecting electricity supply to the petitioner’s residential premises. 2. A report filed by the WBSEDCL Authorities is taken on record. The WBSEDCL Authorities are otherwise ready and willing to effect electricity supply. However, supply could not be effected in favour of the petitioner in view of the objection raised by the private respondent no.7 along with another person. 3. The respondent no.7 contends that for the purpose of effecting electricity supply in favour of the petitioner a pole has been erected upon the private respondent’s land and the electricity line would cross over the private respondent’s property. 2 4. The aforesaid dispute cannot be resolved by this Court in summary proceeding by way of affidavit evidence. 5. In view of the provisions of Rule 3 of the Works of Licensee Rules, 2006, the District Magistrate of the relevant district would be the appropriate authority to resolve such dispute. 6. Accordingly, the petitioner is granted liberty to approach the District Magistrate, Hooghly by way of appropriate representation detailing the petitioner’s grievances. 7. Upon receipt of the petitioner’s representation the District Magistrate, Hooghly shall draw appropriate proceedings, cause inspection to be done and dispose of the petitioner’s representation by a reasoned order in accordance with law upon hearing all parties. 8. The inspection would be done upon giving advance notice to the petitioner, the private respondent, the WBSEDCL Authorities and the other objectors. All parties shall be furnished with copies of the inspection report and shall be afforded an opportunity to take exception thereto. All parties will be entitled to show alternative 3 ways from which electricity can be supplied to the petitioner. 9. The District Magistrate, Hooghly shall conclude the aforesaid exercise by passing a reasoned order in accordance with law, as aforesaid within a period of eight weeks from the date of making of the representation. 10. The reasoned order shall be communicated to the parties within a week from passing thereof. 11. The future course of action shall be guided by the order passed by the District Magistrate, Hooghly in the said proceedings. 12. Accordingly, WPA 20871 of 2026 stands disposed of. No costs. 13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
