The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Sessions Trial No.4 of 2025 (Case Crime No.246 of 2024), “State Vs. Sahab Singh alias Sabbi”, pending before the court of learned Additional District and Sessions Judge, Ramnagar, District Nainital under Sections 109, 190, 1 2026:UHC:460 191(2), 191(3), 117 and Section 61 of the Bharatiya Nyaya Sanhita, 2023. 2 . According to the respondent-State, on 05.08.2024, Lovepreet Gill and five unknown persons beat the husband of the informant, causing him injuries. 3 . Mr. Abhishek Verma, learned counsel for the applicant-accused, Mr. Pratiroop Pandey, learned Assistant Government Advocate for the respondent no.1 and Mr. Arjun Arora, learned counsel for the respondent no.2-informant and respondent no.3- injured. 4 . Applicant is in judicial custody. 5 . Vakalatnama, filed by Mr. Abhishek Verma, Advocate for the applicant, is taken on record. 6 . Respondent no.2 and the respondent no.3 are present through video conferencing. They are identified by Mr. Arjun Arora, Advocate. 7 . This fact is not disputed that four charge- sheets were filed in Case Crime No.246 of 2024. The cases regarding the co-accused persons have already been quashed. 8 . The respondent no.2, the informant and the respondent no.3, the injured submitted that there were 2 2026:UHC:460 private disputes between them and the applicant. All the differences have already been solved. Therefore, a Compounding Application (IA No.01 of 2026) and affidavits have been filed. The respondent no.2 and the respondent no.3 submitted that they have filed affidavits with their free will and without any pressure. 9 . The private respondents have requested to quash the entire proceedings of the said Sessions Trial No.04 of 2025. 1 0 . Mr. Pratiroop Pandey, learned Assistant Government Advocate, has opposed the said request of the private respondents. 1 1 . Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Sessions Trial No.4 of 2025 (Case Crime No.246 of 2024), “State Vs. Sahab Singh alias Sabbi”, pending before the court of learned Additional District and Sessions Judge, Ramnagar, District Nainital, are quashed. 1 2 . Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Sessions Trial No.4 of 2025 (Case Crime No.246 of 2024), “State Vs. Sahab Singh alias Sabbi”, pending 3 2026:UHC:460 before the court of learned Additional District and Sessions Judge, Ramnagar, District Nainital, are hereby quashed. 1 3 .
