petitioner
seeks
appointment
on compassionate ground. Her father died-in- harness on February 24, 2024. She applied for a Group-C post. The name of the petitioner has been enlisted for consideration on compassionate ground in the died-in-harness category in respect of the district Bankura.
2. The petitioner submits that there are vacancies in the district of Paschim Medinipur where her prayer for providing appointment may be considered.
3. A representation by the petitioner dated January 2, 2026 addressed to the West Bengal Board of Secondary Education has been relied upon wherein the petitioner has mentioned five districts where she may be considered for providing appointment.
4. Learned counsels for the respondents oppose the prayer of the petitioner. It has been submitted that the petitioner applied for the job in the district of Bankura and that her application was considered only in respect of the district of Bankura.
5. Upon hearing the respective submissions made on behalf of both the parties and on perusal of the documents annexed to the writ petition, it appears that the petitioner’s prayer for being considered for a job in the other districts is pending consideration.
6. Whether the petitioner would at all be entitled for appointment on compassionate ground in any of the districts disclosed by her is to be decided by the superior authority who has information of the complete vacancy position of all the districts.

The Commissioner of School Education being the fourth respondent is directed to consider the prayer of the petitioner for grant of compassionate appointment in any of the five districts as mentioned in her representation dated January 2, 2026 keeping in mind that the father of the petitioner since deceased was serving in the district of Bankura. For taking a decision in the matter, the live register maintaining seniority shall be strictly followed.
8. A decision by the Commissioner shall be taken at the earliest but positively within a period of eight weeks from the date of communication of this
order.
9. A reasoned order shall be passed and communicated to the petitioner immediately thereafter. 2
10. If the petitioner is found eligible for being appointed on compassionate ground, then necessary consequential steps shall be taken by the competent authority in accordance with law.

Learned counsel for the petitioner shall forward a copy of all relevant documents to the Commissioner of School Education at the time of communicating the order of this Court.
12. It is made abundantly clear that the Court has not decided the issue as to whether the petitioner would be entitled to be considered for compassionate appointment in respect of any other district apart from Bankura. The Commissioner of School Education shall decide the issue in accordance with law.
13. The writ petition stands disposed of.
14. All parties are to act on the server copy of this
