JUSTICE E.S.INDIRESH - 3 - HC-KAR CNR: KAHC010333632026 NC: 2026:KHC:49039 WP No. 15015 of 2026 ORAL ORDER In this writ petition, petitioners are assailing the communication dated 29.11.2025 (Annexure-A) issued by the respondent No.1. 2. Sri Sunil Rao, learned counsel appearing for the petitioners contended that, though the impugned communication (Annexure-A) is internal communication between the respondent - Authorities, however, it affects the rights of the petitioners, where a finding has been given as to the genealogical tree of the family of the petitioners is concerned. Accordingly, sought for interference of this Court. 3. Sri P. V. Chandrasekhar, learned counsel appearing for the KIADB-respondent Nos.2 and 3 submitted that, the said communication is only between the respondent -Authorities, and therefore, sought for dismissal of the writ petition and also brought to the notice - 4 - HC-KAR CNR: KAHC010333632026 NC: 2026:KHC:49039 WP No. 15015 of 2026 of this Court as to the subsequent developments made pursuant to the issuance of Annexure - A. 4. Learned Additional Government Advocate appearing for respondent No.1 also sought to defend the impugned communication at Annexure - A. 5. Heard the learned counsel appearing for the parties. 6. Though the said communication at Annexure - A dated 29.11.2025 is between the respondent - Authorities, however, the finding recorded by the respondent - Authorities would indicate as to determine the rights of the parties, particularly, the petitioners is concerned. 7. In that view of the matter, unless the affected persons were to be heard in the matter, the respondent No.1 ought not to have issued the impugned communication to the respondent Nos.2 and 3. - 5 - HC-KAR CNR: KAHC010333632026 NC: 2026:KHC:49039 WP No. 15015 of 2026 In that view of the matter, I pass the following: ORDER i) The writ petition is allowed. ii) The communication dated 29.11.2025, produced at Annexure-A, is accordingly set aside. iii) The matter is remitted to respondent No.1 to take a decision in the matter in the light of the observations made above, after affording an opportunity of hearing to all the parties concerned, and take a decision, in accordance with law.
