2. The challenge in this application is to the award of interim maintenance of Rs. 25,000/- per month granted by the learned Judicial Magistrate First Class under the Domestic Violence Act. The non-applicant/wife has claims for final maintenance of Rs.25,000/- per month. Out of total arrears an amount of Rs.3,32,000/- has been paid by the applicant and an amount of Rs.2,68,000/- is due. 2 41-revn-87-26.odt Court was not inclined to interfere in the impugned order granting interim maintenance. However, upon instructions, Shri Rai, learned counsel for the applicant makes a submission that the applicant is ready to deposit remaining amount of Rs.2,68,000/- within a period of four months and shall continue to pay amount of interim maintenance of Rs.20,000/- per month to the non-applicant/wife, if this Court directs dispose of maintenance proceedings pending before the Judicial Magistrate First Class (under Domestic Violence Act), expeditiously.
3. Shri Bhagwani, learned counsel though opposed the said request however concedes that applicant has shown his bonafide by depositing Rs.3,32,000/-, still Rs. 2,68,000/- is due. Shri Bhagwani,
learned counsel, upon instructions, submits that appropriate order may be passed for early disposal of the maintenance proceedings as well as regular payment of the maintenance amount to the non- applicant/wife.
4. After taking into consideration the order passed by the learned Judicial Magistrate First Class, Nagpur, granting maintenance and the prayer made by the non-applicant/wife, claiming maintenance SKNair
3 41-revn-87-26.odt amount to the tune of Rs.35,000/- per month, it appears that reasonable offer is made by the applicant. Hence, I am inclined to pass the following order.
ORDER i. Criminal Revision Application is allowed; ii. The impugned order dated 18.02.2025 passed by the learned Judicial Magistrate First Class, Nagpur below Exhibit 5 in Misc. Criminal Application No. 3622 of 2024 and impugned order dated 21.02.2026 passed by the learned Additional Sessions Judge, Nagpur in Criminal Appeal No. 208 of 2025 are hereby quashed and set aside, subject to the condition that the applicant shall deposit an amount of Rs. 2,68,000/- within a period of four months before the learned Judicial Magistrate First, Class, Nagpur. iii. The applicant shall pay an amount of interim maintenance as Rs.20,000/- per month directly in the account of non-applicant/wife till the disposal of the maintenance proceedings, pending before the learned Judicial Magistrate First Class, Nagpur. The learned Judicial Magistrate First Class, Nagpur shall make an endevour to dispose of the petition-E-3622 of 2024 as early as possible and not beyond a period of one year. v. Failure on the part of the applicant to regularly deposit the amount of Rs.20,000/- per month with the non-applicant/wife or failure on the part of the applicant to deposit the remaining balance amount due i.e. Rs. 2,68,000/- within a period of four months, shall entail in the cancellation of the aforesaid order passed by this Court.
5. With these observations, the revision application stands
disposed of.
