[2026:RJ-JP:11016] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 2264/2026 Naresh S/o Gel Chand, age about 50 years, R/o Asawata Mod Brajnagar Ward No. 10 Palwal Police Station City Palwal, District Palwal (H.R.). (Accused At Present Confined in District Jail Deeg). ----Petitioner Versus State of Rajasthan, through P.P. ----Respondent For Petitioner(s) : Mr. Mritunjya Sharma For Respondent(s) : Ms. Manju Dave, P.P. HON'BLE MR. JUSTICE RAVI CHIRANIA Order 16/03/2026 1. This misc. bail application has been filed by the petitioner Naresh S/o Gel Chand, aged about 50 years, who is behind the bars since 03.01.2026 in connection with the FIR bearing No.124/2025 dated 11.04.2025 registered at Police Station Sikari, District Deeg for the offences punishable under Sections 115(2), 108 and 3(5) of B.N.S.. 2. Learned counsel submitted that the petitioner has been falsely implicated in the present case and he has not committed any such offence. Learned counsel for the petitioner further submitted that the deceased consumed some substance on account of which he died. However, at that time his family members and relatives informed the police that due to some confusion the deceased had willfuly consumed some substance on account of which he died. No foul play was reported at that time to the police and the body was taken after the postmortem. In [2026:RJ-JP:11016] (2 of 2) [CRLMB-2264/2026] view thereof, learned counsel prayed that the petitioner has been falsely implicated so he may be enlarged on bail. 3. Learned Public Prosecutor strongly opposed the bail application. This Court noted from the contents of the FIR, which reveal that the alleged incident occurred on 17.12.2024, and the FIR was not lodged immediately, however, it appears that the impugned FIR was lodged after a lapse of four months. There is no justification for the the delay in lodging the FIR. 4. Be that as it may. 5. This Court after considering the fact that the trial will take sufficiently long time, nature of allegations, petitioner is behind the bar since 03.01.2026, and considering the overall facts and circumstances of the case, is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Naresh S/o Gel Chand on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Naresh S/o Gel Chand shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA),J 47 - RAVI KHANDELWAL
