Mr. Amitava Pain Mr. Partha Pratim Mukhopadhyay Ms. Aparna Dhali …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant no. 1 and is directed against an order dated July 23, 2026 passed by the learned Civil Judge (Sr. Division), Serampore, Hooghly in Title Suit No. 176 of 2021. By the order impugned the application for local inspection at the instance of the defendant nos. 2 to 8, stood allowed. Mr. Pain, learned advocate appearing for the petitioner submits that the petitioner has not disputed that he has constructed a doctor’s chamber at the undivided property. He submits that in view of such admitted fact, there is no necessity to hold a local inspection. After going through the application for local inspection this Court finds that it has been alleged that the doctor’s chamber has been constructed by using the common passage which will lead to serious 2 breach of privacy and change the nature and character of the suit property. After going through the points of local inspection this Court is of the considered view that the learned trial judge was right in directing the local inspection to be held on the scheduled property. At this stage Mr. Pain, learned advocate appearing for the petitioner submits that since the suit is pending from the year 2021, the learned trial judge be directed to dispose of the same expeditiously. He submits that several interlocutory applications are pending. The learned trial judge shall make an endeavour to dispose of the interlocutory applications as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory applications, the learned trial judge shall make an endeavour to dispose of the Title Suit No. 176 of 2021 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. CO 2997 of 2026 stands disposed of accordingly. (Hiranmay Bhattacharyya, J.)
