The petitioner who is the Pradhan of Jaigaon Gram Panchayat has assailed the notice of meeting issued by the Prescribed Authority on 25th August, 2026 on the ground that the no confidence motion was not sent to her at the residential address. It appears from the copy of postal receipt submitted by the private respondent that copy of the motion was sent to the petitioner at his residential address on 25th August, 2026, indicating compliance with Section 12(2) of the West Bengal Panchayat Act, 1973. Admittedly, the members including the petitioner/Pradhan participated in the meeting and a resolution has been taken.
2 In view of the above, this Court is inclined to hold that the writ petition is devoid of any merit and is liable to be dismissed. Accordingly, the writ petition is dismissed. The Prescribed Authority is directed to take consequential steps pursuant to the resolution arrived at in the meeting. There shall, however, be no order as to costs. The gist of this order be communicated to the Prescribed Authority by the State at the earliest. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
