THIS WRIT APPEAL IS FILED UNDER SECTION 4 OF THE KARNATAKA HIGH COURT ACT, 1961, PRAYING TO SET ASIDE THE IMPUGNED ORDER PASSED IN WP NO.12359/2023 DATED:12.11.2025 AND CONSEQUENTLY DISMISS THE WRIT PETITION BY RESTORING THE AWARD PASSED BY THE LABOUR COURT IN IDA NO.11/2021.

ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH)
This writ appeal is filed impugning the judgment and
order dated 12.11.2025 passed by the writ Court in WP.No.12359/2023.
2. The parties have settled their disputes amicably outside the Court and have filed a joint memo recording the terms of settlement, which reads as under:

"The respondent corporation to reinstate the appellant into service to the post held by the appellant at the time of dismissal, with notional fixation of pay from the date of actual reinstatement ie., 10.04.2023 till date with consequential benefits.

2. The fixation of pay being notional from the date of actual reinstatement, the appellant is not entitled for any financial benefits including arrears of wages if any from the date of dismissal till 1.5.2026 and he has to report to duty on 2.5.2026 by producing fitness certificate, Effective Driving Licence and Conductors licence and such other documents as specified by the department concerned.
3. The appellant is not entitled for continuity of service, consequential benefits, backwages from the date of dismissal ie., 15.4.2021 till the date of actual reinstatement ie., 10.04.2023."
3. In view of the settlement of the dispute between the parties, as recorded above, the writ appeal is
disposed of in terms of the said settlement.
4. The parties, along with their respective counsel, are present and have affixed their signatures on the settlement agreement.
