For the Respondent no. 4 Learned counsel for the petitioner submits that her bank account with the HDFC Bank bearing no. 50100738657794 has been frozen by the Bank pursuant to instruction given by Cyber Crime Police Station, Siliguri Police Commissionerate. The petitioner has been suffering for a long time due to unjust freezing of her account. She undertakes to cooperate in investigation. Learned counsel for the Bank submits that the account has been frozen in terms of the request made by the Cyber Crime Police Station, Siliguri Police Commissionerate. It appears from the report submitted by the State that pursuant to a complaint lodged by one Garima Chhetri on 9th September, 2024 investigation is being held. During preliminary enquiry it is found that the allegedly siphoned amount which has been debited from the account of the complainant has been transferred to the bank account of the petitioner. Besides this complaint several other 2 complaints in various States are also pending against the petitioner involving the said bank account. In such backdrop, this Court is of the view that the bank account of the petitioner cannot be directed to be defrozen till completion of investigation. The writ petition is accordingly dismissed. There shall be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
