GP FOR LAW LEGISLATIVE AFFAIRS 3 The Court made the following ORDER: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue, appearing for the respondents. 2) This Writ Petition is filed seeking to declare the action of the respondent authorities in not considering the petitioner’s representation dated 12.09.2025, and the recommendation sent by the 4th respondent vide proceedings in Dis.No.6177, dated 25.10.2025, for the allotment of Assistant Government Pleader (AGP) / Government Pleader (GP) posts from among the members of the Bar Association, Chintalapudi, as illegal, arbitrary, and contrary to public interest. Consequently, the petitioner seeks a direction to the respondents to consider the said representation and take necessary steps to appoint an Assistant Government Pleader for the Court of the Civil Judge (Junior Division), Chintalapudi, from among the eligible members of the Chintalapudi Bar Association within a stipulated time frame. 3) The learned counsel for the petitioner, while reiterating the contentions raised in the Writ Petition, places reliance on Rule 5(3)(b)(ii) of the Andhra Pradesh Law Officers (Appointment and Conditions of Service) Instructions, 2000 (issued vide G.O.Ms.No.187, dated 06.12.2000). He submits that in violation of the said rule, 4th respondent was appointed as Assistant Government Pleader, who is from the Eluru Bar Association. Such appointments to the detrimental of the members of the Bar Association, Chintalapudi, is depriving them of the opportunity to be appointed as Assistant 4 Government Pleader and the same is going on for several years. Learned counsel further submits that because the appointed Assistant Government Pleader is from the Eluru Bar Association, and attending the Court at Chintalapudi only on specific dates (usually the 1st and 2nd Fridays), severe inconvenience to both the litigant public and the Court is being caused. Therefore, he prays for a direction to the respondents to consider future appointments in terms of G.O.Ms.No.187, dated 06.12.2000, and send a panel of Advocates from local Bar Association of Chintalapudi. 4) Learned Assistant Government Pleader for Home, in view of relief prayed for the Writ Petition, while making submissions has not objected for passing appropriate orders. 5) Considering the submissions made and keeping in view the guidelines issued under G.O.Ms.No.187 dated 06.12.2000, as well as the innocuous nature of the prayer, this Court is of the view that the matter can be disposed of without going into merits of the case. 6) Accordingly, the Writ Petition is disposed of with a direction to the respondents to consider appointment of an Assistant Government Pleader to the Court of the Civil Judge (Junior Division), Chintalapudi, as and when vacancy arises / expiry of tenure from among the eligible members of the Chintalapudi Bar Association, strictly in accordance with Law and the applicable guidelines.
