CORAM :
SRI ANANDA SEN, J.
For the Petitioner(s) : Mr. Kaushik Sarkhel, Advocate
For the State : Mr. Saket Kumar, AddI. P.P.
…...... 05/20.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 302 and 34 of the IPC.
2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order.
3. Petitioners are the brother-in-law and sister-in-law of the deceased.
4. The investigation against these petitioners are pending and at a very belated stage, the chargesheet was filed. The chargesheet against the husband was filed earlier and ultimately after a proper trial, the husband has been acquitted in S.T. Case No.9 of 2024 by learned Principal Sessions Judge, Jamtara.
5. Considering the fact that the husband has been acquitted after proper trial as the witnesses could not say as to how the deceased died and there is doubt about the prosecution case and only on conjecture and surmises, the persons have been made accused, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamtara in connection with Bindapathar Police Station Case No.76 of 2023,
corresponding to G.R. Case No.533 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
